Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the GoalPosition mobile application and website at goalposition.app (collectively, the "Service"), operated by GoalPosition ("we," "us," or "our").
By downloading, installing, or using GoalPosition — including as an anonymous user — you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms incorporate our Privacy Policy, which describes how we collect and use your information.
The Service
GoalPosition is a task management and social competition application. The Service allows you to:
- Create and manage personal task lists and to-do items
- Compete with friends, family, or co-workers by racing to complete your respective task lists
- Track real-time competition progress
- Use the app offline with automatic sync when connectivity is restored
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.
Accounts & Identity
Anonymous use
You may use GoalPosition without creating an account. When you first open the app, we create an anonymous session that lets you use all core features immediately. Your data is stored under a random identifier on your device and in our cloud database.
If you uninstall the app or lose access to your device without having created a registered account, your data may not be recoverable. We are not responsible for loss of data associated with anonymous sessions.
Registered accounts
You may optionally create a registered account with an email address and password. You are responsible for:
- Providing accurate and complete information when creating your account
- Maintaining the security and confidentiality of your password
- All activity that occurs under your account
- Notifying us immediately at support@select37.com if you believe your account has been compromised
Display names
New users are assigned a random "Adjective-Animal" display name (e.g., "Swift Falcon"). You may update your display name at any time. Display names must not impersonate another person, be offensive, or violate these Terms. We reserve the right to change or remove display names at our discretion.
Age requirement
You must be at least 13 years of age (or 16 in the European Economic Area) to use GoalPosition. By using the Service, you represent that you meet this requirement.
Your Content
Ownership
You retain ownership of all task lists, task descriptions, and other content you create in GoalPosition ("Your Content"). We do not claim ownership of Your Content.
License to us
By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, display, and synchronize Your Content solely to operate and improve the Service. This license ends when you delete Your Content or your account.
Shared content in competitions
When you participate in a competition, your display name, avatar, list name, and task completion progress are visible to other competition participants. Individual task titles within your competition list are visible to other participants for the duration of the competition. You are solely responsible for choosing what content you associate with a competition.
Your responsibility
You represent and warrant that Your Content does not violate any law, infringe any third-party rights, or violate these Terms. We are not responsible for the accuracy, legality, or appropriateness of Your Content.
Acceptable Use
You agree to use GoalPosition only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Harass, threaten, intimidate, or harm other users
- Upload or transmit viruses, malware, or any other malicious code
- Attempt to gain unauthorized access to any part of the Service, its servers, or its databases
- Scrape, crawl, or otherwise extract data from the Service without our written permission
- Use automated bots, scripts, or other automated methods to interact with the Service
- Reverse-engineer, decompile, or disassemble the app or attempt to derive its source code
- Sell, resell, or commercially exploit the Service without our written permission
- Create a false identity, impersonate another person, or misrepresent your affiliation with any entity
- Interfere with or disrupt the integrity or performance of the Service
We may investigate suspected violations of these Terms and may take any action we deem appropriate, including removing content, suspending accounts, or contacting law enforcement.
Competitions
How competitions work
GoalPosition allows you to create friendly competitions with other users. Each participant associates one of their task lists with the competition and races to complete all tasks. Competitions are intended for personal motivation and friendly rivalry.
Invitations and consent
When you invite someone to a competition, they receive a notification and must accept before they are considered a participant. By accepting a competition invitation, a user consents to their competition progress being visible to other participants.
No prizes or rewards
GoalPosition competitions are for personal motivation and social fun only. We do not offer monetary prizes, rewards, or any compensation to competition winners. Any celebrations or win screens within the app are purely symbolic.
Fair use
Do not create competitions designed to harass or pressure others. Do not manipulate competition results through unauthorized means. Violations may result in account suspension.
Intellectual Property
Our property
The Service and its original content, features, functionality, design, code, trademarks, and branding — excluding Your Content — are and remain the exclusive property of GoalPosition and its licensors. Nothing in these Terms grants you any rights to use our trademarks, logos, or brand elements without our prior written consent.
Feedback
If you submit feedback, suggestions, or ideas about the Service to us, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use that feedback in any way, including incorporating it into the Service, without compensation to you.
Copyright complaints
If you believe that content on the Service infringes your copyright, please contact us at legal@select37.com with a description of the allegedly infringing material and your contact information.
Third-Party Services
GoalPosition uses third-party services to operate, including Supabase (database and authentication), PowerSync (offline sync), and Expo (app distribution and push notifications). These services have their own terms of service and privacy policies that apply to their respective operations.
The Service may contain links to third-party websites or services. We are not responsible for the content, terms, or privacy practices of any third-party websites or services, and your access to them is at your own risk.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Any defects or errors will be corrected
- The Service or the servers that make it available are free of viruses or other harmful components
- Your data will never be lost or corrupted, including data stored in anonymous sessions
GoalPosition is a personal productivity and entertainment tool. It is not a professional productivity platform and should not be relied upon for critical business operations.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GOALPOSITION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM:
- Your use of or inability to use the Service
- Any content obtained from the Service
- Unauthorized access to or alteration of your data
- Loss of data associated with anonymous sessions
- Any other matter relating to the Service
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF ONE HUNDRED US DOLLARS (USD $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (WHICH IS ZERO IF YOU HAVE NOT PAID US ANYTHING).
Some jurisdictions do not allow certain liability exclusions, so some of the above may not apply to you.
Termination
By you
You may stop using GoalPosition at any time by uninstalling the app. If you have a registered account, you may request deletion of your account and data by contacting us at support@select37.com or through the account settings in the app.
By us
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately.
Effect of termination
Sections of these Terms that by their nature should survive termination — including Your Content (ownership provisions), Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law — will survive.
Changes to Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice through the app or by email (if you have a registered account with an email address).
Your continued use of GoalPosition after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in the United States, and you consent to personal jurisdiction in those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
